The Family Law team at HBJ Gateley Wareing is dedicated to the provision of specialist advice on all aspects of separation, divorce, pre-nuptial, cohabitation and child-related matters.

The Family Law team provides clear, common sense advice and is sensitive to the needs of clients through what can be a traumatic time. At HBJ Gateley Wareing we offer the services of an accredited specialist in both Child and Family law. The team frequently deals with unusual, complex and high value cases, such as cross-border disputes, same-sex applications in respect of children, child-related matters and high net worth cases involving businesses, farms and inherited wealth.

Where possible, settlement is sought without resort to court. Our lawyers are members of the Family Law Association and as such adhere to its code of conduct which focuses on a child-friendly, non-acrimonious approach to dispute resolution.

In addition, we are able to offer Collaborative Law as another means of dispute resolution. Collaborative Law is a cost-effective, child-friendly approach to dispute resolution where both clients and their solicitors attend "four-way meetings" and attempt to deal with issues face-to-face in a respectful and constructive manner.

The ultimate aim of the collaborative model is that both parties have input in the process and that they work together with the help of their lawyers to achieve the best settlement possible, in the interests of their family. The collaborative model recognises that each family is unique and seeks to maintain, where possible, family relations.

Collaborative Law 

What is Collaborative Law?
Collaborative Law is a new option for separating couples to resolve disputes respectfully without going to court.  The process is more open, less adversarial and lays the foundation for a healthier relationship after divorce.

Who is it for?
Anybody who wants to move forward in a positive way, and who wants to avoid court for the benefit of the family.

There are, however, occasions when court is necessary and the team at HBJ Gateley Wareing is well versed in conducting cases in both the Court of Session and the Sheriff Court.  Where appropriate, we are also able to secure the services of Advocates of the highest calibre.

The Family Law team is strategically placed to ensure that their advice is complemented by that provided by other specialists within our Private Client and Financial Services team. Other such advisors include taxation advisors who can advise on the tax implications of separation and divorce; independent financial advisors* providing advice on pension/investment related issues; property experts who can provide the best advice in relation to the matrimonial home; and trust and succession specialists who can advise on all aspects of estate planning.
